Complete Terms & Conditions for Phoenix Coaching Online, LLC
These terms (the “Agreement”) are between you (“you” or “Client”) and Phoenix Coaching Online, LLC (PCO). This website is owned and operated by Wix. These Terms set forth the terms and conditions under which you may use our website and services as offered by us.
This website offers visitors access to blog information and service information. By accessing or using our service website, you approve that you have read, understood, and agree to be bound by these Terms.

PCO reserves the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms.
Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Expertise
We provide support for women facing challenges within their relationships, whose relationships are impacting multiple areas of their lives internally and externally.
​
At PCO, we believe every woman should have a place to share and heal. Our specialized services are rooted in our own experiences and education. Due to the topics and nature of our services, we only provide services for women 18 years and older.
We encourage those who do not meet these criteria and/or who are outside the scope of our practice to seek specialized help and services for their specific needs and circumstances.

Scope
Although some coaches with and associated with PCO may have varying education, certifications, and licenses in therapeutic practices, PCO Coaches do not provide therapy services, treatment, or interventions in any capacity.
​
Physical violence and other crimes are outside the scope of PCO Group, Class, Course and Individual Sessions. Thus, we encourage victims of physical abuse or crime to contact their local domestic violence shelter for guidance.
​
Similarly, PCO Coaches and Services do not offer legal counsel. Legal counsel is outside the scope of the information you’ll receive on the, website, social media or any other service at PCO.
​
Key Commercial Terms
When buying an item, you agree that:

you are responsible for reading the full item listing before making a commitment to buy it.

you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

All sales are final and refunds will not be provided for any reason.
​
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
​
Retention of Right to Change Offering
PCO, without prior notice, can change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
​
No Refunds
Individual Sessions, Group Sessions, Classes, and Courses must be paid in advance; and are non-refundable and expire in 1 month.
​
Individual Sessions can be rescheduled up to 24 hours before the session start time and can only be rescheduled once within the service period.
​
Classes, Courses, and Groups are non-refundable and will occur on the day and time listed for the service and cannot be rescheduled or made up for.
​
Access to PCO Group, Courses, or Class Sessions are automatically deducted each month (with membership) until you cancel. Your card is charged using a secure third-party payment processor.
​
If you don’t attend a Group, Course, or Class Sessions (or several sessions), your monthly fee will remain active, until you cancel. For that reason, you will be charged your membership fee per month until you cancel through the PCO member login or reach out to PCO in writing with your signature your request to cancel. You may contact phoenixcoachonline@gmail.com to do so.

Although you can cancel your access to PCO Group, Course or Class sessions at any time, the first payment and any monthly fees thereafter are non-refundable. If you don’t want to be charged again, make sure you cancel your access before the next monthly fee occurs.
​
Bank & Credit Card Disputes
When you pay for individual, group, courses or class session, you consent to PCO charging your debit or credit account. When you pay for any PCO Service, we document that you consented to have your card charged, saved, and agreed to these terms, including our no refund policy.
​
Any PCO charge you dispute will be refuted using that documentation. If you dispute PCO charges, you’ll be blocked from utilizing our services in the future. So rather than dispute, email phoenixcoachonline@gmail.com if you have questions about a charge.
​
Resolving Bank & Credit Card Disputes
If you’ve disputed a PCO charge, but would like access to our services again, take the following steps to void the dispute:

Call your credit card company or bank where you disputed the charge[s].

Ask to speak with a representative.

Tell the representative that you made a mistake and you want to void the dispute.

Ask them how to void the dispute.
-
Follow the steps they give you and void the dispute.
As soon as you’ve voided your dispute, email phoenixcoachonline@gmail.com with documentation that shows it’s voided, and we’ll review the situation.

Representations
PCO Sessions, groups, courses, and classes are not a substitute for licensed mental health care. As a client, you understand that to receive a diagnosis or treatment plan, you need to visit a practicing licensed mental health professional under those conditions.
​
You agree NOT to seek any diagnosis or treatment from PCO.
​
PCO and its staff members cannot treat or prevent a mental illness.
​
We can’t and don’t…
a. conduct professional evaluations of an individual’s mental health, mental illness, or emotional disorder;
b. diagnose mental health conditions;
c. prescribe treatment for mental illness or emotional disorders;
d. administer treatment for mental illness or emotional disorders
​
You agree to not look to or rely upon PCO for any of the above-listed services. You understand and agree that PCO isn’t providing mental health services and that you’re fully responsible for your physical and emotional well-being before, during, and after utilizing any PCO service.
​
PCO Sessions, classes, groups, or courses are not a substitute for licensed legal counsel. As a client, you understand that you need to consult with a licensed legal professional to receive legal advice or counsel. You agree to not seek any legal advice from PCO. We cannot resolve or prevent legal issues.
​
We can’t and don’t . . .
a. conduct professional evaluations of an individual’s legal issues or disputes;
b. determine legal liabilities;
c. suggest legal solutions;
d. administer legal actions or proceedings.
​
You agree to not look to or rely upon PCO for any of the above-listed services. You understand and agree that PCO isn’t providing legal services and that you’re fully responsible for your legal matters before, during, and after utilizing any PCO service.
​
Safety
PCO is here to support women and provide them with a safe space to heal and learn.
​
PCO Coaches come to Sessions, Classes, Groups and Courses on time and free from distractions and respectfully request that you do the same.
Our Owner or Coaching Leader may periodically drop into Groups, Courses and Classes to ensure client safety.
​
For your safety and the safety of the PCO Team, you agree that you won’t receive coaching services from any PCO Coach outside of PCO. You’ll immediately notify phoenixcoachonline@gmail.com at any suggestion that you receive services from them outside of PCO.
​
Due to the delicate nature of the client’s circumstances and experiences prior to attending PCO services, we ask that all clients adhere to some general safety precautions so that each and every woman, no matter her situation or background, can feel secure in our Sessions.
​
For your safety, clients must follow the Group, Class, and Course Guidelines

PCO’s groups, classes, and courses are intended to support women-identifying individuals that include but are not limited to all races, nationalities, religions, and sexual orientations. Participants of these services agree to respect each member’s pronouns, beliefs, and views during these services.

Members will avoid discussions, comments, posts, and topics of political views, religion, spiritual orientation, or other discriminatory language and/or interactions.

For everyone’s safety, you may not share your PCO Client Login information, use a PCO Client Login that is not your own, or create a PCO Client Login for someone else. All PCO Groups, Classes, Courses, and individual Sessions and/or posts and comments must come from their own PCO Client Login.

You MUST be in a room alone when you attend a Group, Class, Course, and/or Individual Session. If others are in the home, please be in a different room with the door closed and wear headphones to protect the safety and confidentiality of other Clients. If you need to attend to something else, please notify your facilitator and leave the Session and return when you are free from distractions.

PCO Group, Class, Courses, and Individual Sessions Clients are strictly prohibited from recording for any reason. Recording Sessions will result in immediate termination of access to PCO services in every capacity without refund of any fees paid to date.

For everyone’s safety, we must be able to identify you. First Name, Last Initial, and Video check upon Group Session entry is required. Use only your first name and last initial for your Zoom screen name and be on camera to be admitted into the PCO Group, Class, Course, and Individual Session. Video must be on the entire time. Do not put your personal contact info (last name, email or phone number) as your Zoom name. Clients who violate this policy will be removed from Group, Class, and Course Sessions.

Depending on how many women are in the session or the flow of the session, it’s at the coach’s discretion whether to admit late arrivals.

Because safety is our first priority, PCO Coaches won’t share your contact information with anyone or facilitate you sharing your contact information with anyone.

Be mindful of time. Everyone who wishes to share deserves an equal opportunity to speak and get feedback. With that, you will not interrupt or disrupt the flow or instruction of the service. If it is determined you are in violation of this, you will be immediately removed from your service with no refund.

Share time may not be available if you log into the PCO Group Session after check-in. Group Sessions are meant for shares of around 5-10 minutes or less. If you’d like a longer share, schedule an Individual Session. We recommend you attend no more than one Group Session per day.

Acknowledging that many professionals or influencers may have helped you on your journey to emotional safety, promoting other programs, or soliciting in Group, Class, and/or Course Session clients toward services outside of PCO is not appropriate. For safety reasons, PCO only endorses local domestic violence shelters and other Mental Health professionals for services beyond PCO, as we cannot assess the safety of other professionals or programs.

Although we have a PCO Group, Class, Course and Individual Sessions schedule, the PCO Coach facilitating any given group or session may change at any time with adequate notice to its clients. If adequate notice is not realistic, PCO will discuss the appropriate next steps to ensure the situation is mediated within the framework of the terms of the agreement.

Our Sessions, Courses, Groups, Classes, Posts, and Comments are intended to be a safe space for women; therefore, the expression, mentioning, intention, or insinuation of sexual contact and/or romantic interest of other members, participants, and/or staff is strictly prohibited. Any participant and/or member engaging in this behavior will be removed from all PCO access and services at PCO’s discretion without refund.

In the spirit of safety and community, we encourage our members to refrain from harsh language and terminology that may be offensive.

Graphic descriptions may harm many clients, so we don’t share graphic details.

Clients will not engage in alcohol or substance use or be under the influence of alcohol or substances during Class, Course, Group, and/or Individual sessions. If it is determined that the participant is under the influence during a service. The participant will be removed immediately without a refund.

Some Groups, Classes, Courses and Individual Sessions won’t be held on holidays, such as: New Years Eve, New Years Day, Easter, Mother’s Day, Father’s Day, 4th of July, Thanksgiving, Christmas Eve, and Christmas Day. If a service will not be held the members of that service will be informed no later than the week prior.

Occasionally, unforeseen events such as natural disasters, accidents, emergencies, or illness may result in the temporary cancellation of a Group Session or several Group Sessions.
No Guarantees
Summaries on the PCO website are intended to provide information about the possible experience of clients and shouldn’t be understood as a guarantee or assurance of future success in any matter. The results portrayed were dependent on a variety of factors and circumstances unique to the particular individuals, including specific facts and circumstances of the matter, the choices of the individuals involved, and unanticipated events. Thus, the results obtained by others – whether clients of PCO or otherwise – by applying (or not applying) the principles set forth in PCO services or educational resources aren’t a guarantee that you or any other person or entity will be able to obtain similar results.

Using any PCO service, website, social media or educational information, you accept personal responsibility for the results of your actions. You agree to take full responsibility for any harm or damage you suffer as a result of the use, or non-use, of the information available at PCO through our services or educational resources. You agree to use judgment and conduct due diligence before taking any action or implementing any plan or action suggested or recommended, and accept full personal responsibility for your choices and actions.

You agree that the PCO has not made any guarantees about the results of utilizing our services. You recognize that your ultimate success or failure will be the result of your own efforts, your particular situation, and innumerable other circumstances beyond the control and/or knowledge of PCO.
​
Release
You hereby release, waive, and forever discharge PCO, its owners, contractors, agents, successors, and employees – any member of the PCO Team – from every claim for damages you may now have as well as those you may yet acquire arising out of actions or omissions of the PCO Team to the full extent permitted by law.
​
You further declare and represent that you are competent to enter this Agreement and do so of your own free will and that no promise, inducement or agreement not herein expressed has been made to you to enter into this release. The release made pursuant to this paragraph shall bind your heirs, executors, personal representatives, successors, assigns, and agents. If you breach any of the terms of this Agreement in any way, you agree to be responsible for paying all damages incurred by PCO, including, but not limited to any out-of-pocket costs, expenses, and attorney’s fees regardless of whether litigation is required.

You understand that PCO Coaches won’t provide testimony or verification of participation for legal, medical or any other purposes.
​
Furthermore, if any PCO Team Member is required to appear as a witness or to otherwise perform work related to any legal matter, the party responsible for the PCO’s Team Member’s participation agrees to reimburse PCO at the rate of $600 per hour for time spent traveling, speaking/corresponding with attorneys or other court professionals, reviewing and preparing documents, testifying, being in attendance, and any other case-related costs.

Referrals
You agree that any non-PCO service, including but not limited to people interviewed, professionals, programs, etc, and/or non-PCO services referenced by a PCO Coach or other clients is in no way intended to be an endorsement of that person, program, or service. You agree and acknowledge that it’s your responsibility to choose what professional services you use, and that PCO will not be held responsible for damages caused by any other person, program, or service.
​
It is impossible to ensure that any given therapist, program, attorney, or any other resource is safe for a variety of reasons. Because of this, we don’t make local recommendations for therapists, attorneys or any other professional services. However, PCO Coaches are equipped to help you research resources in your local area during a session if you’d like support.
​
Our website will likely contain links to other websites. PCO has no control of such websites and you agree that these websites aren’t under our control and aren’t subject to our terms. We have no responsibility for these websites or the services provided by such websites. You acknowledge that your use and access of these websites is at your own risk. It’s your responsibility to check the privacy policies and other legal documents of these websites to see how they treat your personally identifiable information.

Ownership of Intellectual Property, Copyrights and Logos
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of PCO. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Non-Disparagement
Because PCO won’t disclose the identity of clients and therefore can’t respond to or refute such disparagement publicly without revealing confidential information about the client, you agree that you won’t at any time make, publish or communicate to any person or entity or post on any public forum a defamatory or disparaging remark, comment or statement concerning PCO or any of its Owners, Directors, Coaches, Team Members, or clients. Doing so may result in immediate termination of services and blocking access to PCO Group, Class, Course, and Individual Sessions and may result in legal action. Similarly, PCO agrees to not make any public statements on any forum about your use of any PCO services, including refuting untrue statements or claims made against PCO unless compelled by a judge’s order.

Confidentiality
You are strictly prohibited from recording Individual, Class, Course, Group and/or Sessions, as well as posts or comments by any of its members or participants for any reason. Recording Sessions is in violation this Agreement will result in immediate termination from all PCO access and services without refunding all fees paid to date. We ask that you keep the names of Group, Class, and Course Session clients confidential, although we can’t guarantee that clients will keep confidentiality. Please note that any comments or posts you make on the website or blogs may be visible and accessed by website visitors, and we recommend you do not provide any identifiable information within these posts or comments as we cannot guarantee your privacy.

Privacy
We are committed to maintaining the privacy of our users. When utilizing any service at PCO, you agree to be added to the PCO’s email list, to receive communications from PCO. You can always opt out of receipt of further email correspondence. We don’t and won’t disclose, give, sell, rent, or trade your name, email, or phone number to any unaffiliated third party and will only disclose it if required by law.

Users must provide a payment to use our services. Users understand and agree that we cannot control nor can we be liable for the acts of our payment processors, and you agree to hold PCO harmless from any liability for security incidents or damages that third-party payment processing services may incur.
​
PCO uses reasonable safeguards to protect personally identifiable information about Users. Only PCO admins who need the information to perform a specific job are granted access to such personally identifiable information.
​
Jurisdiction
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of The United States/ Ohio, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Fairfield County Courts. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Entire Agreement
This Agreement contains the entire agreement between PCO and Client. If any provision of this Agreement is invalid or unenforceable, the remainder of the Agreement shall not be affected.
